I. BACKGROUND

 

The Government of the Republic of Tajikistan has received grant funding in the amount of US$50.0 million from the World Bank for the implementation of the "Learning Environment – Foundation of Quality Education Project” (the Project, LEARN) during 2023-2029. The Project will be implemented by the Ministry of Education and Science (MOES), and in close coordination with the Agency for Supervision in the Sphere of Education and Science (ASSES).

 

The Project Development Objective is to enhance the quality of teaching and learning environments in selected general secondary schools. “Teaching and Learning environment” in this project refers to the complete physical, social, and pedagogical context in which learning is intended to occur. The teaching and learning environment in this project is defined as consisting of the skills and competencies of teachers and physical learning spaces where learning occurs . It is school settings (not just classrooms) and contexts in which students learn and teachers teach within the school premises.

II. OBJECTIVE OF THE ASSIGNMENT

 

The main objective of the assignment is to provide professional assistance in technical supervision services to ensure that construction work is carried out in accordance with construction contracts and that the work meets:

 

(i) the required standards of workmanship and materials;

(ii) (ii) acceptable environmental standards;

(iii) (iii) the approved project implementation schedule;

(iv) (iv) the approved project budget.

 

The main objective of construction supervision is to obtain timely and up-to-date information on the progress and stages of construction of school institutions in all regions of the Republic of Tajikistan, as well as quality control of reconstruction/construction works, as well as verification of executive documentation, such as compliance of certificates and other technical documentation for structures, parts, building materials and equipment with the requirements of the State Standards of the Republic of Tajikistan and technical conditions of work sites.

III. SCOPE OF SERVICES

 

The consultant's duties include performing his duties as the Client's representative, delegating authority to the Project Director appointed by the Client if such delegation is permitted by the contract, and delegating authority to perform construction management and technical supervision of the site.

 

The consultant performs his duties as the Client's representative on the construction site and is responsible for all duties set out in this section, as well as all other duties set out in the General Conditions of Contract and in the Special Conditions of Contract, as described in the standard tender documents for the procurement of small works.

 

The duties and responsibilities of the Consultant in different periods of the Assignment, such as construction supervision, commissioning, defective period, among others, include:

 

Task A. Detailed Design Quality Review

 

The expected outcome of this task is that all design documents have been reviewed and received to an acceptable quality and completeness. The consultant’s responsibilities include, but are not limited to:

 

a) Carrying out a complete and quality review of all documents prepared under another contract before they are accepted by the Client;

 

Task B. Construction Services and Commissioning.

 

The expected outcome of this task is that all construction work is supervised and delivered correctly.

 

This period is devoted to the actual construction work on site, up to and including final testing at completion and commissioning in accordance with the Contract Documents, as well as the management and control of all necessary and requested changes to the scope of work during construction, as the case may be. Carrying out all necessary services to be performed by the Project Manager in the execution of the work under any contract, including supervision of any specific tasks on site and commissioning. The consultant’s responsibilities include, but are not limited to:

 

а) Provide site supervision and liaison with the contractor, including supervision of day-to-day construction activities to ensure materials and construction quality comply with design and specifications.

 

b)  Oversee the design and provision of equipment to the contractor for construction.

 

c) Review and processing of the methods, construction schedules, materials, etc. submitted by the construction contractors, including proposed changes during the term of the contract. The consultant shall, where necessary, provide written comments on the design documentation and working drawings prepared by the contractor. All types of related calculations, reports, designs, quantity schedules and technical specifications shall also be reviewed.

 

d) Carry out incoming inspection of materials and finished structures and products used at the enterprise by the Contractor during construction, including: to check the correctness of the incoming inspection by the Contractor of the quality of construction work, participation in audit commissions, conducting random independent tests, checking the completeness and correctness of laboratory tests carried out by the Contractor;

 

е) To coordinate the execution of works of the next stage of the contract between the Customer and the Contractor in accordance with the construction schedule, to control the compliance of the scope of construction and installation works in the amounts established in the documents, to control the execution by the Contractor of the construction schedule approved by the Client;

 

f) Review, evaluate and process requests from construction contractors for changes, claims and protests throughout the term of the contract.

 

g) Carry out acceptance control of works, intermediate acceptance certificates for critical structures and inspection certificates for hidden works, check documentation for the transfer to operating organizations of reconstructed utility lines, networks, buildings and structures developed by the Contractor.

 

h) Review and confirm (or return for correction) all requests for interim payment for payment to contractors, prepare summary reports on the volume of work performed by the Contractor and their cost, monitor the completeness and correctness of the execution of executive documentation;

 

i) Ensure the completion of the work.

 

j) Prepare and implement changes jointly with the Client.

 

k) Participate in all technical and organizational meetings within the framework of the execution of the contract between the Client and the Contractor, provide legal support and ensure representation of the Client's interests during technical supervision (construction control);

l) Administer and mediate any disputes with construction contractors in accordance with the terms of the contract. Promptly inform the Client of any events and circumstances that may adversely affect the quality of the works, increase the cost of the contract or suspend the execution of the construction works;

 

m) Ensure that financial management procedures for the project are in place and strictly followed, in particular with regard to payments, financial reporting, requests for extension of time, as well as the Contractor's claims and invoices. Check and certify the volume of work performed, as well as process interim and final payments prepared by the Contractor, ensure timely provision of interim payment certificates to the Client, monitor and monthly confirm the correctness of construction and installation documentation, project implementation deadlines, acceptance certificates for completed works and invoices for payment to the Client in order to confirm further payment.

 

n) Monitor the implementation of environmental measures under the Agreement between the Client and the Contractor;

 

o) To ensure that the Contractor adheres to and implements the necessary actions regarding labor standards in accordance with the contract documentation, such as awareness and education of employees and workers, and to ensure that the Contractor does not use child or forced labor during construction work.

 

p) To prepare monthly reports on the progress of construction.

 

Task C. Services during the defective period.

 

Expected result of this task: all completed works are inspected and identified defects are corrected by the Contractor. The consultant's responsibilities include, among others:

 

q) To monitor the site during the defective (warranty) period, to provide the Contractor with relevant reports on the condition of the site, to draw up a list of defects, to draw up defect reports, to conduct claims and, if necessary, procedural actions to eliminate existing defects and defects.

IV. QUALIFICATION REQUIREMENTS

 

The consulting firm should demonstrate the following qualifications:

 

a. General experience in implementing contracts for consulting services in the field of design and construction supervision over the past 7 years;

b. Proven profile of the firm in carrying out author's and construction supervision of construction using best practices in various countries over the past 5 years, experience in the post-Soviet countries (CIS) and experience in projects financed by IFIs will be considered as an additional advantage;

c. Having specific experience in carrying out engineering supervision of building construction over the past 5 years, 2 contracts for technical supervision for a total of at least USD 250 thousand over 5 years.

VI. SUBMISSION OF EXPRESSIONS OF INTEREST

 

Ministry of Education and Science of the Republic of Tajikistan/Learning Environment – Foundation of Quality Education Project (LEARN) now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

 

Note: Key Experts will not be evaluated at the shortlisting stage.

VII. PROCUREMENT ARRANGEMENTS

 

A Consultant will be selected in accordance with the Consultant Qualification Selection (CQS) method set out in the Procurement Regulations.

 

The attention of interested consultants is drawn to Section III, paragraphs 3.14, 3.16 and 3.17 of the World Bank’s ‘Procurement Regulations for IPF Borrowers’ July 2016 revised December 2020 [Procurement in investment Project Financing; Goods, Works, Non-Consulting and Consulting Services], setting forth the World Bank’s policy on conflict of interest.

 

Consultants may associate with other firms to enhance their qualifications, but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.
